    Medical Termination of Pregnancy, or MTP, is the legal, medically supervised process of ending a pregnancy in India. Depending on how far along the pregnancy is, this can be done using medication or a minor surgical procedure.

    MTP is governed by a specific law the MTP Act which sets out exactly when and how a pregnancy can be legally terminated, and by whom.

    Is Abortion Legal in India? Understanding the MTP Act

    Yes abortion is legal in India, and has been since 1971, under the Medical Termination of Pregnancy Act. This is a common point of confusion, since many people assume it isn’t legal at all.

    The law was significantly updated through the MTP (Amendment) Act, 2021, which expanded access to safe abortion and increased the gestational limits for many women. Here’s what current law actually allows:

    Up to 20 weeks of pregnancy — Termination requires the opinion of one registered medical practitioner (RMP).

    Between 20 and 24 weeks — Termination requires the opinion of two RMPs, and is available specifically for certain categories of women, including:

    • Survivors of sexual assault or rape
    • Victims of incest
    • Minors
    • Women with disabilities
    • Women whose marital status changed during the pregnancy (such as widowhood or divorce)
    • Cases of contraceptive failure importantly, this provision now applies to unmarried women as well as married women, following the 2021 amendment

    Beyond 24 weeks — Termination is only permitted with approval from a state-level Medical Board, and only in cases involving substantial foetal abnormalities.

    At any stage — If a doctor determines that continuing the pregnancy poses an immediate risk to the woman’s life, termination can be performed regardless of gestational limits.

    Who Can Access MTP, and Until When?

    In practical terms, this means:

    • Most women can access MTP up to 20 weeks with a single doctor’s opinion
    • Women in the specific categories listed above can access MTP up to 24 weeks with two doctors’ approval
    • Beyond 24 weeks, it becomes significantly more restricted and requires medical board involvement, generally limited to serious foetal health concerns

    It’s worth knowing this clearly, because a lot of outdated information online still only mentions the 20-week limit without the 2021 changes which can lead women to believe they have fewer options than they actually do.

    Methods of Abortion

    Medical (Medication) Abortion — Using a combination of Mifepristone and Misoprostol, this method is typically used for pregnancies up to 9 weeks. It involves taking medication under medical guidance, followed by cramping and bleeding as the pregnancy is expelled — similar to a heavy period.

    Surgical Abortion — For pregnancies between roughly 9 and 20 weeks, procedures like vacuum aspiration or dilation and curettage (D&C) may be used. These are typically quick outpatient procedures performed under local or general anaesthesia.

    Later-Stage Procedures — For pregnancies requiring termination after 20 weeks (within the legal framework described above), the method depends on gestational age and individual circumstances, and is guided closely by the treating specialist.

    What Does the MTP Process Actually Involve?

    Consultation — The process begins with a consultation with a registered gynaecologist, who reviews your medical history, confirms the pregnancy and gestational age (usually via ultrasound), and discusses which method is appropriate.

    Pre-Procedure Tests — Basic blood tests and an ultrasound are typically done to confirm gestational age and rule out complications like ectopic pregnancy.

    The Procedure Itself — Depending on the method, this involves either taking medication over a day or two, or a same-day surgical procedure.

    Follow-Up — A follow-up visit or scan is usually recommended to confirm the procedure was complete and there are no complications.

    Is MTP Safe?

    When performed under proper medical supervision by a qualified doctor, in an approved facility MTP is safe, whether medical or surgical.

    Mild cramping and bleeding, similar to a period, are normal and expected for several days afterward. Serious complications are uncommon when the procedure is done correctly and under medical care, which is exactly why choosing a registered provider matters so much, rather than attempting unsupervised methods.

    Possible Side Effects and Complications

    Most people experience only mild, temporary effects:

    • Cramping and bleeding for several days, sometimes up to two weeks
    • Nausea, fatigue, or mild fever (more common with medication abortion)
    • Emotional responses ranging from relief to sadness both are normal and valid

    Less common but important to know about:

    • Incomplete abortion, which may require a follow-up procedure
    • Infection, if proper aftercare guidance isn’t followed
    • Heavy bleeding requiring medical attention

    This is exactly why follow-up care matters, and why any unusual symptoms very heavy bleeding, fever, severe pain, or foul-smelling discharge should be reported to your doctor promptly rather than waited out.

    Your Rights and Confidentiality Under the Law

    The MTP Act specifically protects your privacy. The law states that your name and personal details related to a pregnancy termination cannot be disclosed to anyone, except to a person specifically authorised by law.

    You also have the right to:

    • Make this decision without needing your partner’s or family’s consent (only your own consent is legally required)
    • Receive the procedure from a qualified provider in a proper medical setting
    • Access accurate information about the procedure and any risks involved
    • Confidentiality throughout the process

    Knowing these rights matters many women aren’t aware that spousal or parental consent (for adults) isn’t a legal requirement for accessing MTP.

    Abortion Myths Busted

    “Abortion leads to infertility.”

    When performed safely by a qualified provider, MTP does not affect future fertility or your ability to conceive again.

    “Medical abortion is painful and unsafe.”

    It’s generally safe under medical supervision. Cramping and bleeding are expected and manageable, similar to a heavy period, and typically resolve within days.

    “You need your husband’s or family’s permission.”

    Legally, only the pregnant woman’s own consent is required not a spouse’s or family member’s.

    “Only married women can access abortion for contraceptive failure.”

    Since the 2021 amendment, this provision explicitly includes unmarried women too.

    “Abortion pills can be taken without medical guidance, since they’re ‘natural.'”

    Medication abortion should always be taken under medical supervision to confirm gestational age, rule out ectopic pregnancy, and manage the process safely.
